Terms of Service

These Terms of Service ("Terms") govern access to and use of the WhatsTunnel platform, a product by Suppper. By creating an account or using our services, you agree to these Terms in their entirety.
1. Definitions
- "Platform" — the WhatsTunnel software, including all features, APIs, integrations, and related services.
- "User" — any individual or legal entity that creates an account and uses the platform.
- "Account" — the user's registration on the platform, including settings, data, and linked sub-accounts.
- "AI Employee" — the artificial intelligence agent configured by the user to serve via WhatsApp and other channels.
2. Eligibility
To use the platform, you must be at least 18 years of age and have the legal capacity to enter into contracts. By registering on behalf of a company, you represent that you have authorization to represent it.
3. Registration and account
You are responsible for maintaining the confidentiality of your access credentials. All activities performed on your account are your responsibility. Notify us immediately in case of unauthorized access at [email protected].
4. Plans and payment
- Plans are billed monthly via credit card (Visa and Mastercard).
- The billing cycle starts on the subscription date and renews automatically each period.
- In addition to the plan, variable costs per AI-sent message are charged according to the language model used (detailed values on the pricing page).
- Add-ons (extra AI employees, additional WhatsApp, etc.) are charged proportionally to the remaining period of the cycle.
5. Cancellation and refund
- You can cancel your plan at any time. Access remains active until the end of the already paid period.
- 7-day guarantee: if you request cancellation within the first 7 days after subscribing, we refund 100% of the amount paid. Simply contact us at [email protected].
- After the guarantee period, there is no proportional refund for early cancellation.
6. Acceptable use
By using the platform, you agree not to:
- Send spam, unsolicited messages, or illegal content via WhatsApp or other channels.
- Violate the usage policies of WhatsApp, Meta, or any integrated channel.
- Use the platform for fraudulent, defamatory activities or activities that violate third-party rights.
- Attempt to access data from other accounts or compromise platform security.
- Resell or sublicense access to the platform without authorization (except under the sub-accounts/white label model, when available in your plan).
- Use AI to generate content that violates local, national, or international laws.
Violation of these rules may result in immediate suspension or termination of the account, without refund.
7. Artificial Intelligence
AI agents are assistance tools and do not replace professional advice (medical, legal, financial, etc.). The user is responsible for:
- Configuring and training agents with accurate and up-to-date information.
- Monitoring AI responses and intervening when necessary.
- Ensuring that the use of agents complies with legislation applicable to their industry.
We are not responsible for incorrect, inaccurate, or inappropriate responses generated by AI.
8. Intellectual property
The WhatsTunnel platform, including code, design, branding, documentation, and features, is the property of Suppper. Using the platform does not grant the user any intellectual property rights over it.
Data and content entered by the user (AI training information, contacts, messages) remain the property of the user.
9. Service availability
We strive to keep the platform available 24/7, but we do not guarantee uninterrupted availability. Scheduled maintenance will be communicated in advance whenever possible. We are not responsible for downtime caused by:
- Issues with third-party servers (WhatsApp, OpenAI, infrastructure providers).
- User's internet connection failures.
- Force majeure (natural disasters, cyber attacks, etc.).
10. Limitation of liability
To the maximum extent permitted by law, WhatsTunnel and Suppper shall not be liable for indirect, incidental, special, or consequential damages arising from the use or inability to use the platform, including loss of profits, data, or business opportunities.
Our total liability is limited to the amount paid by the user in the last 12 months of use.
11. Changes to terms
We may modify these Terms at any time. Significant changes will be notified by email or through the platform with at least 15 days' notice. Continued use of the platform after changes constitutes acceptance of the new terms.
12. Governing law and jurisdiction
These Terms are governed by the laws of the Federative Republic of Brazil. The courts of São Paulo/SP are elected to resolve any disputes arising from these Terms.
